Welcome to Realtistics (“we,” “our,” or “us”). Realtistics is a licensed Texas real estate brokerage (TREC License No. 9009355). By accessing or using https://getrealistics.com (the “Site”), you agree to be bound by these Terms of Service (“Terms”). Please read them carefully. If you do not agree, please do not use the Site.
1. Use of the Site
You agree to use the Site only for lawful purposes. You must not:
- Violate any laws or regulations.
- Infringe the rights of others.
- Interfere with the operation of the Site.
We may suspend or terminate your access if you violate these Terms.
2. Real Estate Information and Performance Claims
All information on the Site, including property listings, agent profiles, performance statistics, and related resources, is provided for general informational purposes only.
Important:While we strive to present accurate and reliable data, we do not guarantee the accuracy, completeness, currency, or reliability of any listings, agent profiles, performance statistics, or market information displayed on this Site. Agent performance metrics, sale price comparisons, and any figures such as “$100K more than expected” or “98% of list price” reflect historical data for specific transactions and are not guarantees or predictions of future results. Individual results will vary based on market conditions, property characteristics, and other factors.
You are responsible for independently verifying any information before making any real estate or financial decisions based on it. We strongly encourage you to consult directly with licensed professionals.
3. Brokerage Status and Nature of Relationship
Realtistics is a TREC-licensed real estate brokerage (License No. 9009355). Certain interactions with our Site may constitute “brokerage activity” under Texas law (Tex. Occ. Code § 1101.002), and Texas law may impose duties on us in connection with those activities regardless of any disclaimer.
While use of this Site alone does not create a formal client representation agreement, we do not disclaim all legal duties that may arise under Texas real estate law or TREC rules as a result of our licensed status and referral activity. If you are connected with a licensed real estate agent through our Site, any formal agency or representation relationship will be established directly between you and that agent pursuant to a separate written agreement.

4. Referral Fee Disclosure
Realtistics is free to home sellers and buyers. When you select a real estate agent through our Site, we receive a referral fee from that agent, paid from the agent’s standard commission.
5. Agent “Verified” Badge
Certain agent profiles on our Site may display a “Verified” badge. This badge indicates that Realtistics has confirmed the agent’s active TREC license and validated the accuracy of the performance data displayed on their profile using publicly available MLS and transaction records. The “Verified” designation does not constitute an endorsement of the agent’s services, a guarantee of future performance, or a recommendation by TREC or any government authority.
6. Testimonials
Our Site may feature consumer testimonials. Results described in testimonials reflect the individual experiences of those consumers and are not necessarily representative of typical results. Individual outcomes will vary depending on market conditions, property type, location, and other factors. No compensation was paid to consumers for providing testimonials unless otherwise expressly disclosed.
7. Intellectual Property
All content on this Site, including text, graphics, logos, and software, is owned by or licensed to Realtistics. You may not copy, reproduce, distribute, or create derivative works without our prior written permission.
8. Third-Party Links
Our Site may contain links to third-party websites. We are not responsible for the content, services, or practices of third-party sites. Access these sites at your own risk.
9. Disclaimer of Warranties
The Site is provided “as is” and “as available” without warranties of any kind, either express or implied. We do not warrant that the Site will be error-free or uninterrupted. This disclaimer does not affect any statutory rights you may have under Texas law.
10. Limitation of Liability
To the maximum extent permitted by applicable law, Realtistics shall not be liable for any damages arising from your use of the Site, including but not limited to indirect, incidental, special, or consequential damages. In no event shall our total liability to you exceed the greater of (a) the amount you paid us, if any, in the twelve months preceding the claim, or (b) one hundred dollars ($100). Nothing in these Terms limits our liability for fraud, gross negligence, willful misconduct, or any liability that cannot be excluded under applicable law.
11. Dispute Resolution and Arbitration
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.
Informal Resolution: Before initiating any formal dispute, you agree to contact us at support@getrealistics.com and provide written notice of your dispute. We will attempt to resolve the matter informally within 30 days of receipt.
Binding Arbitration:If informal resolution fails, any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Site shall be resolved by binding individual arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules, which are available at www.adr.org. The arbitration shall be conducted in Austin, Texas (or remotely if mutually agreed). The arbitrator’s decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
Class Action Waiver: YOU AND REALTISTICS AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING.
Notwithstanding the foregoing, either party may seek emergency injunctive or other equitable relief in a court of competent jurisdiction to prevent irreparable harm pending arbitration.
12. Governing Law and Venue
These Terms are governed by the laws of the State of Texas, without regard to its conflict of laws principles. For any matters not subject to arbitration under Section 11, you consent to exclusive jurisdiction and venue in the state and federal courts located in Travis County, Texas.
13. Privacy
Your use of the Site is also governed by our Privacy Policy. By using the Site, you consent to the collection and use of information as described in the Privacy Policy.
14. Accessibility
We are committed to making our Site accessible to all users, including those with disabilities. We are working toward compliance with WCAG 2.1 Level AA standards as required by ADA Title III and the DOJ’s final accessibility rule (effective April 2026). 15. Changes to These Terms
